General terms and conditions

  1. General Information

Happy Hounds & Cooler Cats represent its members who provide a range of pet care services. All members act as part of a team enabling them to provide cover for each other to ensure an uninterrupted service for clients as much as possible.

All members of Happy Hounds & Cooler Cats undergo a rigorous checking, training and assessment process to ensure the members suitability to carry out the services for which they have been engaged. All members are fully insured either via their own insurance or through Happy Hounds & Cooler Cats, DBS checked, trained, assessed and monitored.

All members adhere to a clear code of conduct and enjoy the support of other members and the Happy Hounds & Cooler Cats office to provide ongoing training, support and guidance on best practice.

  1. Definitions

All references to HH&CC mean Happy Hounds & Cooler Cats Ltd.

All references to sitters refer to members of HH&CC

All references to clients or pet owners refer to service users

  1. Cover and fulfilment

Service users will have a primary sitter or walker but if this person is unavailable, then other similarly qualified sitters or walkers will provide backup cover to ensure your pet care is covered and you’re not let down at the last minute.

  1. Permissions
  • Service users will be deemed to have accepted HH&CC terms and conditions (as laid out here) on booking of services.
  • The service user gives HH&CC permission to enter their property to carry out the booked service at the arranged date and time.
  • The service user must provide HH&CC with a name and contact telephone number of someone capable of making a decision relating to their pet(s) in an emergency. A nominated vet’s details will also be recorded, and they will be contacted if we are unable to communicate with the service user or their representative. Please note that in an emergency we will use any nearest vet.
  1. Dog safety, security and health
  • All dogs must wear a collar and tag with the telephone number of the owner engraved upon it.
  • Dog must be in a secure location prior to collection by the dog walker. Loose in a garden does not constitute this.
  • All dogs must be provided with a well-fitting collar / harness. No member is held liable for any injury or any damage caused or incurred by the service user’s dog escaping due to an ill-fitting or faulty collar / harness.
  • HH&CC and its members will not confirm any booking until there has been a consultation with the owner who must disclose any behavioural or medical condition that may make their dog unsuitable for group walks. This would include, but is not limited to, antisocial behaviour, aggression, possessive behaviour, lack of training and conditions such as incontinence, chronic vomiting or travel/ mobility problems.
  • HH&CC and its members must be informed if your dog does or has EVER used a muzzle and this should be made available for use at our discretion
  • HH&CC reserve the right to refuse or discontinue walks for any dog deemed to be unsuitable for group walks.
  • Where possible walks are carried out in forest and parkland where dogs can be safely walked off the lead.
  • We walk a maximum of 6 dogs per walker to ensure a safe and enjoyable walk for all dogs in our care and ensure we walk temperamentally as well as geographically suitable dogs together. The size of group will alter according to local permissions and circumstances.
  • Unless there are exceptional circumstances walks are at least 1 hour in length not including pick up and drop off.
  • In extreme weather conditions (e.g. very hot weather or heavy snow) walks may be shorter to ensure the comfort of the dogs. This will be at the dog walker’s discretion.
  • All dogs being exercised must be fully vaccinated (including kennel cough) and be on regular flea and worm control treatment.
  • Clients must inform HH&CC if their dog contracts any infectious condition (e.g. Kennel cough, conjunctivitis). Any dog with an infectious condition will not be walked until cleared to do so by a vet.
  • Towels should be provided if you wish your dog to be wiped down following the walk especially in adverse weather.
  • Though we endeavour to ensure the safety of all dogs, letting dogs walk off the lead carries a risk therefore we will only do this with your express permission.
  1. Cat safety, security and health
  • We will act for you in your absence if we are unable to contact you
  • Animals are fully insured to travel in any vehicle driven by your pet carer. Unless you state otherwise, these terms and conditions assume that you, the client, have given permission for this.
  • We do recognise that cats are independent creatures and as such often are left to come in and out freely. Unfortunately, accidents do happen and as such we cannot be held responsible for the safety of any cat that is allowed to come in and out.
  • If cats need to be brought in, i.e. do not have a cat flap but are let out anyway, we will do our very best to call and ensure we’ve seen them, and will wait a reasonable amount of time, carry out duties and if the cat hasn’t turned up we will have to leave.  We will endeavour to ensure the cat is in but we cannot guarantee it.
  • It is a condition precedent to liability that the property owner has arranged with their household insurer to extend their policy to cover losses incurred whilst there is a pet sitter present.
  • It is a condition precedent to liability that all locks, security and protective measures are put in operation whenever the property is left unattended or overnight, whether or not the pet sitter is present.
  • Clients must provide a spare set of keys to the sitter. These may be left at the property for the sitter to pick up on the first visit. This second set of keys will then be left at the client’s home on the last visit. If this is not possible, then the details of a local key-holder who will be available during the period of care must be provided. If neither of these is possible, then a second set of keys will be cut by your sitter at a charge of £10 plus the cost of cutting.

 7.        Insurance:  

All sitters, walkers and vehicles are insured for the safe care and transport of your animal.  Animals are fully insured to travel in any vehicle driven by your pet carer.  Unless you state otherwise, these terms and conditions assume that you, the client, have given permission for this.

HH&CC and its members have comprehensive insurance covering public liability, vet fees and loss or straying, however we advise all clients to have their pets insured and reserve the right to refuse a booking for any animal who is not insured.

If your sitter has their own insurance, rather than through Happy Hounds & Cooler Cats, any claim made will go via their own insurance. It is taken as a given that by using Happy Hounds & Cooler Cats you are happy to abide by these conditions and that any sitter provided to you will be providing you directly with services and will be covered by their own insurance policy.

  • Public Liability which will cover injury and damage to third parties and their properties up to a maximum of £5 million Limit of Indemnity.
  • Vets fees in respect to injury to animals in our custody and control, subject to a limit of £10,000 and an excess of £50. This does not cover pre-existing conditions or care that would have occurred whether or not the animal is under the care of the company.
  • Cover for the loss or straying of animals in our custody and control up to a maximum of £1,000 per animal. This includes cover during collection and delivery.

It is a condition precedent to liability that all locks, security and protective measures are put in operation whenever the property is left unattended or overnight, whether or not the pet sitter is present.

8.        Keys

2 sets of keys must be provided.  For dog services – keys retained by your walker will be kept securely and will only be marked with the name of your dog and an office code.

9.        Parking Permits

Permits for any service where the sitter is at your home for a significant period must be provided if you are in a restricted parking zone. Any pet sitting, puppy care, cat care etc requires this. Group dog walking and daycare do not require this.

All service users can make booking requests by using the online booking area at www.happyhounds.co.uk and individual log-in access to our client portal will be provided.

  1. Payment

Invoices should be paid within 7 days of receipt. If you do not make any payment to us, or if we are unable to collect a payment from you by the due date, we may charge you interest on the overdue amount.

You can use the following methods: debit/ credit card, online transfer or direct debit.

You can choose to have payment take on issue of invoice with a registered card, or set up a Direct Debit to have your payments taken on the 15th of the month.

Direct debit payments that bounce will incur a charge of £14.50 for each time they are re-presented.

Using HH&CC services constitutes acceptance of these terms and conditions.  These terms and conditions may change at any point and we will ensure the latest version is available on our website. General

The commissioning of the Company by the Client to carry out Pet Sitting, house sitting, Home Boarding or Pet Visiting assignments, whether verbally or in writing constitutes acceptance of these Terms of Business.

Our Agreement

The Company agrees to supply Pet Sitting, house sitting or Home Boarding or Pet Visiting services in accordance with a Brief provided by the Client. Which will primarily include the care of pets and other animals owned by the Client. In consultation with the pet sitter the client may request other services such as the maintenance of house, greenhouse, garden plants and lawns. All within reasonable limits which will be charged per service if the pet sitter agrees.

The Company will continue to provide these services throughout the duration of the Agreement even though the original sitter may fall ill or be unable to continue on assignment for whatever reason.

Payment

The Client agrees to settle the Company’s invoice for such services two weeks prior to the commencement of the assignment. Unless the assignment was booked at short notice; in such cases, the Client agrees to settle the Company’s invoice before the assignment commences.

In respect to long-term or on-going assignments, invoicing of fees can be set up on a monthly basis.

If payment is not received in accordance with these Terms of Business, the Company will not be obliged to honour any previously agreed arrangements.

The Client is responsible for ensuring that neither the house and its environment, nor the work expected of the sitter, present any avoidable or unusual risks recognised by the Health and Safety Executive.

Refunds may be considered for a Client’s early return.

Rules of Employment

All pet sitters are insured to carry out their duties only through the company and all instructions to them must come from or with the approval of the Company Management Personnel.

Sitters may not work for a Client, except through the Company. Infringement of this condition will jeopardise their role as a pet sitter for the Company.

Insurance

Every reasonable measure is taken to ensure the integrity, probity, suitability and competence of the sitters. Appropriate vetting and police checks are carried out and the Company covers its Employees with Public Liability Insurance.

The Company’s insurance cover only operates when the sitter is working on an assignment from the Company and for the duration and times of the selected service.

Where sitters are required to drive a Clients car, responsibility for the provision of appropriate insurance cover rests with the Client.

It is agreed that it is the Clients responsibility to adequately insure the property and its contents and any pets with an insurance company of good repute, and that such insurance shall continue for the duration of this agreement. You must ensure that your household insurer has extended their policy to cover losses incurred whilst there is a house-sitter present. Please note that Happy Hounds & Cooler Cats Ltd will accept no liability for any damage caused by your house or pets.

All locks, security and protective measures are put in operation whenever the property is left unattended or overnight.

Miscellaneous

Where exceptional work or non standard skills and experience are involved e.g. the care of horses, farm animals, aviaries, large gardens, green houses, indoor plant collections, and swimming pools etc, charges will be made according to the level of skill required. Approximate guides will be provided by telephone and detailed quotations. All extra work must be approved by the pet sitter.

No payments are made directly to the pet sitter.

In place of leaving supplies of food for the sitter, an impractical option, a daily subsistence allowance is paid directly to the sitter from your payment to Happy Hounds & Cooler Cats Ltd.

A reservation, whether written or verbal, constitutes a binding agreement, and as such, all cancellations incur a £25 fee. This fee will be fully refunded on any future booking. This fee covers all administration costs.

A sitter may wish to have the companionship of their partner / spouse during an assignment. This incurs the Client no additional expense. The companion / spouse will have passed the Company’s vetting programme and is also fully covered by the Company’s insurance.

“You” means the owner of the dog named on the booking form and “your” shall be construed accordingly; “we” means the Happy Hounds & Cooler Cats Ltd and its representatives and “our” or “us” shall be construed accordingly; “Booking Form” means the document completed by you at any time you seek to book one of our carers and “the” or “our” “Head Office” means the administrative offices of the organisation, currently at: 33 Connaught Road, London E11 4AB. Terms of Use:
All bookings, whether confirmed or pending an introductory meeting, are subject to our terms of use. Submission of a Booking Form constitutes acceptance of these terms and your continued use of our service will indicate your acceptance of the terms in force. As these terms may vary from time to time, you should make sure you are aware of the current version which is available upon request from our Head Office.

Drop off and Pick up times:
These times must be agreed between the owner and the carer. The earliest you may drop off your dog is 8am and the latest pick up is 7pm unless otherwise agreed.

Our Commitment To You:
We aim to meet the highest standards of care in the course of operating as a pet care company and promise to use all reasonable endeavours in providing a suitable carer to board your dog/s, based on the information provided by you in the Booking Form.

Insurance

All boarders and vehicles are insured for the safe care and transport of your animal. Animals are fully insured to travel in any vehicle driven by your pet carer. Unless you state otherwise, these terms and conditions assume that you, the client, have given permission for this.

Dogs will be exercised on a flexi-lead unless other arrangements have been made.

It is a condition precedent to liability that all locks, security and protective measures are put in operation whenever the property is left unattended or overnight, whether or not the pet sitter is present.

Payment

Material Disclosure:
You undertake to make full and complete disclosure in the Booking Form of any matter, fact, quality or characteristic which might render your dog unsuitable for home boarding including, but not limited to, behavioural or health problems, anti-social behaviour including aggression, separation anxiety, unspayed bitches in season, excessive pulling on the lead, tendency to run away or escape on walks or in the home, incontinence/lack of housetraining, destructive behaviour inside our outside the home, or excessive loud barking/whining etc. Regrettably, we may not be able to accept young puppies or elderly dogs which are infirm. We will only do so at the discretion of the company. Failure on your part to disclose in the Booking Form any matter which in our view might render your dog unsuitable for home boarding will be deemed a material omission amounting to a fundamental breach of this agreement, entitling us to terminate the agreement forthwith. In such an eventuality, we reserve the right to transfer your dog to kennels at your expense and the fee to Happy Hounds & Cooler Cats Ltd will be payable in full.

Cancellation and/or early collection:

There is a set scale of charges, which applies in the event of cancellation. Payment for the booking is due in advance either by cheque or debit / credit card to head office unless otherwise agreed. For cancellation, you must give notice in writing to our Head Office enclosing any payment due. For the avoidance of doubt, purported cancellation by email or telephone is not valid notice for the purposes of this clause.

To ensure confirmation of bookings falling within peak season (July and August and 15 December and 5 January) payment must be settled 30 days in advance.

Other Conditions

Requirements For Delivery: You agree to at the commencement of the board to supply your dog’s food (including treats, if appropriate) sufficient for the duration of the board in addition to food/water bowls, favourite toys, bedding and exercise leads. If insufficient food is supplied, you agree to refund the Carer for the costs incurred in purchasing additional food.

Condition of Dog on Delivery: You undertake to deliver your dog to the carer or the pet taxi service in a clean, groomed condition and up-to-date with vaccinations, worming and de-flea treatments. Any dog requiring regular grooming should also be provided with appropriate grooming equipment.

Unspayed Bitches: We reserve the right at any time to withdraw from a booking for an unspayed bitch. If there is a risk of your dog coming into season during her board you must advise us of this (see material disclosure clause above) and, if appropriate, you agree to seek the advice of your veterinary surgeon as to measures which may be taken be taken to prevent an unspayed bitch coming into season during her board. We reserve the right to seek written confirmation from your veterinary surgeon that this has been done.

Cancellation By Us: In the unlikely event that the Carer is unable to complete a confirmed booking for any reason, we will use all reasonable endeavours to arrange an introduction to an alternative carer. If, despite our best efforts, we are unable to procure an introduction to an alternative carer, we will refund your booking deposit. If for any reason we consider a dog to be unsuitable for home boarding (or for boarding with any carer available at that particular time), or, if a carer withdraws from a provisional booking within five days following the booking date we reserve the right to cancel such booking and refund the deposit.

Emergency Contact: All reasonable efforts will be made to contact you or the person in the UK you have nominated as authorised to make decisions on your behalf in the event of an emergency. We cannot accept your mobile or other overseas contact for this purpose, as time may be of the essence. Whether or not you wish to be contacted direct when you are overseas is a matter you must address with the person you nominate in the Booking Form. We reserve the right to make decisions regarding your dog provided we are at all times acting in the best interests of your dog and on the advice of a veterinary surgeon.

Veterinary Fees: You agree that we may take your dog to a veterinary surgeon if we suspect he or she is not well and you agree to accept full responsibility for payment of any veterinary fees incurred.

Off-Lead Exercise Instruction: Unless otherwise agreed, your dog will be exercised on a flexi-lead. If you wish the Carer to exercise your dog off the lead, you must sign an  off-lead instruction on the booking form. under which you accept responsibility for third party liability and agree to procure insurance for your dog whilst in our care (which shall include third party liability cover),

Entire Agreement: These terms of use together with the Booking Form will constitute the entire agreement between you and us to the exclusion of any other terms whatsoever, including any terms or conditions you purport apply under any other written or oral communication with us. At our discretion, we may agree to a waiver or variation of these terms provided that it is agreed in advance and is in writing signed by the director of the company.

Bookings Policy: All bookings must be made through the head office. Our carers do not always have the most up to date information about bookings provisionally scheduled for them. If you procure, or attempt to procure, the services of one of our carers direct, whether on your own behalf or on behalf of a third party, you will not be insured for any of the liabilities and at the discretion of the company you will be liable to a fee equal to double the booking fee of the job.

Reasonableness: You agree that these terms of use are fair and reasonable in enabling us (a) to perform our obligations under this agreement to the best of our ability and (b) to protect our legitimate business interests.

Governing Law & Jurisdiction: This agreement shall be governed and construed in accordance with English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

General

Requirements For Delivery:

Cancellation By Us:
In the unlikely event that the Carer is unable to complete a confirmed booking for any reason, we will use all reasonable endeavours to arrange an introduction to an alternative carer. Unless otherwise agreed, your dog will be exercised on a flexi-lead. If you wish the Carer to exercise your dog off the lead, you must sign an off-lead instruction on the booking form, under which you accept responsibility for third party liability and agree to procure insurance for your dog whilst in our care (which shall include third party liability cover).

Entire Agreement: These terms of use together with the Booking Form will constitute the entire agreement between you and us to the exclusion of any other terms whatsoever, including any terms or conditions you purport apply under any other written or oral communication with us. At our discretion, we may agree to a waiver or variation of these terms provided that it is agreed in advance and is in writing signed by the director of the company.

Bookings Policy:
All bookings must be made through the head office. Our carers do not always have the most up to date information about bookings provisionally scheduled for them. If you procure, or attempt to procure, the services of one of our carers direct, whether on your own behalf or on behalf of a third party, you will not be insured for any of the liabilities and at the discretion of the company you will be liable to a fee equal to double the booking fee of the job.

Reasonableness:
You agree that these terms of use are fair and reasonable in enabling us (a) to perform our obligations under this agreement to the best of our ability and (b) to protect our legitimate business interests.

Governing Law & Jurisdiction:
This agreement shall be governed and construed in accordance with English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

Puppy care

Prices

Puppy sitting.

£15.00 for 1 hour or part thereof puppy care, Monday to Friday, 9-5.

£18.00 for 1 hour or part thereof, Monday to Friday after 5pm and on weekends.
£20 half day puppy daycare.
Please ask for separate terms and conditions for multiple dogs, dog walking, dog boarding, house
sitting and pet sitting.

£25 Vet visit for first hour plus £20 for every subsequent hour or part thereof.

Visits

Puppy care visits will last a minimum of 30 minutes. During this time sitters can do 1 or all of
the following:

• Assistance in toilet training

• Lunchtime feeding

• Basic training of key commands based on your existing training but covering STAY, SIT, COME AND FETCH

• Cuddles and play time

• Cleaning up any accidents that may have occurred

• Short walk (Once fully vaccinated)

Pet food
Food, litter and any other requirements are to be provided by the owners. Additional food etc will be purchased if you run out. There will be a £7.50 charge on top of the cost of the provisions.

Insurance

All carers and vehicles are insured for the safe care and transport of your animal. Animals are fully insured to travel in any vehicle driven by your pet carer. Unless you state otherwise, these terms and conditions assume that you, the client, have given permission for this.

Our insurance covers us for Public Liability which will cover injury and damage to third parties and their properties at a £2 million Limit of Indemnity.

Vets fees in respect to injury to animals in our custody and control, subject to a limit of £50,000 and an excess of £25. This does not cover pre-existing conditions or care that would have occurred whether or not the animal is under the care of the company.

Cover for the loss or straying of animals in our custody and control up to a maximum of £1,000 per animal. This includes cover during collection and delivery.

It is a condition precedent to liability that the property owner has arranged with their household insurer to extend their policy to cover losses incurred whilst there is a pet sitter present.

Precedent to liability that all locks, security and protective measures are put in operation whenever the property is left unattended or overnight, whether or not the pet sitter is present.

Payment

Methods of Payment
You can use the following methods: cheque, cash, debit or credit card. Payment by credit card will incur a surcharge of 3.5%. If you prefer internet / telephone banking, you can also make payments directly into our business account. Please ask for account details.

Timing of Payment
Payments should be paid within 7 days of receipt of invoice.

Cancellation Charges
Cancellation more than 1 week's notice no charge.
Less than 1 week's notice 25% total cost.
Cancel less than 24 hours notice 100% of total cost.

Keys & Parking

Keys retained by your sitter will only be marked with the name of your dog.

Parking
Permits must be provided to your walker if you are in a restricted parking zone.
